§ 7-33. Sailing craft; sailing catamarans; power boats; jet skis; prohibition.
(a)
It shall be unlawful for any person to use or ride any sailing craft, sailing catamaran, power boat or jet ski in the surf of the Atlantic Ocean within one hundred (100) yards of the existent (as it moves in and out on the rise and fall of the tides) water line within the corporate limits of the city between the hours of 10:00 a.m. and 6:00 p.m. during the period from Memorial Day to Labor Day of each year, each inclusive; provided, however, during such hours any sailing craft, sailing catamaran, power boat or jet ski shall be permitted to be launched and retrieved through the surf at Seagate Avenue.
(b)
Sailing catamarans and other sailing craft are prohibited from parking so as to block, obstruct or otherwise interfere with the line of sight flag signaling system of the beach patrol lifeguards displayed on towers or platforms utilized for that purpose. Furthermore, it shall be unlawful to leave or abandon any sailing craft or sailing catamaran unattended on the beach within the corporate limits of the city. Thus abandoned, the sailing craft or sailing catamaran shall be removed from the beach pursuant to F.S. Ch. 705.
(c)
In the event of emergency or for reasons of public safety or necessity, the chief of police shall have the authority to temporarily remove, regulate, restrict, limit or prohibit sailing or the use or riding of any sailing craft, sailing catamarans, power boats or jet skis in the surf adjacent to the beach within the corporate limits of the city.
