Article IV. NOTICE OF ABATEMENT AND HEARING |
§ 28-18. Hearing.
(a)
Any person, owning or occupying the property removed or otherwise interested, or any person served with notice under section 28-17, or any other person having a demonstrable ownership occupation interest in the premises, who objects to the proposed removal, suppression or abatement or levy of a special assessment under this chapter, must present objections, in writing to the building official, within ten (10) days of service of the notice, and must request a hearing before the code enforcement board, or the person shall have deemed to have consented thereto.
(b)
The hearing shall be on the first regularly scheduled meeting following the request for the hearing or at such other time as the code enforcement board may schedule, following the request for the hearing.
(c)
The hearing shall proceed in accordance with the procedures in section 2-441 of this Code.
(d)
After the hearing, the code enforcement board, in the exercise of its discretion, may revise, modify or abandon the proposed action.
(e)
If no objection to such action is received by the building official and/or the code enforcement board within ten (10) days of the notice service date, the action in the notice shall become final and binding.
(f)
Any appeal of such action shall proceed as in section 2-445 of this Code.
