§ 27-145.2. Procedures for applying for and issuing a variance for property located within the C-1, C-2, C-3, CBC and conservation zoning districts.

  • (a)

    Submittal of application. The owner or developer shall submit a completed application, as described in section 27-143, to the office of the city manager or designee.

    (b)

    Determination of sufficiency. The city manager or designee shall review the application within five (5) working days of its submission to determine if it is sufficient. When the application is determined to be complete within the requirements of section 27-143, the city manager or designee shall forward the application to the community development board for consideration.

    (c)

    Community development board action. Allowing for proper notice as specified in this division, the community development board shall conduct a public hearing and shall prepare, in writing, its comments and recommendation to the city council for approval, approval with conditions, or denial of the application. Any person at the public hearing shall be afforded the opportunity to be heard.

    (d)

    City council action. At the next available meeting of the city council, allowing for required notice as described in this part, the city council shall approve, deny, or approve with conditions said application after consideration of the comments and recommendations of the community development board, based on the standards set forth in this division.
