§ 23-29. Private wells.

  • (a)

    No person shall drill, bore, sink, drive or otherwise install a surface well, Artesian well or any other type of well within the city without having first obtained a permit therefor issued by the city manager. No permit for a well shall be issued until an application therefor has been filed with the building official containing the following information:

    (1)

    The street address and a description of the lot, piece or parcel of land on which it is desired to drill, drive or bore such well;

    (2)

    The size of the proposed well, including all dimensions, the power of the pump to be utilized and the estimated flow;

    (3)

    The purpose for which it shall be used, which shall be limited in accordance with regulations adopted by the city council and under no circumstances used for domestic household purposes; and

    (4)

    The interest of the applicant in or his title to such land.

    (b)

    Unless the application discloses an improper purpose, the city manager shall issue such permit; provided, however, that each such permit so issued and the well to be installed thereunder shall be subject to such rules and regulations as may be imposed, prescribed or adopted by the city council from time to time. The city council shall adopt such rules and regulations with respect to wells by resolution.
