§ 15-1. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Aggressive manner shall mean:

    (1)

    Approaching or speaking to a person, or following a person before, during or after soliciting or begging, if that conduct is intended or is likely to cause a reasonable person to (1) fear bodily harm to oneself or to another, damage to or loss of property, or (2) otherwise be intimidated into giving money or other thing of value, or (3) suffer unreasonable annoyance or alarm.

    (2)

    Intentionally touching or causing physical contact with another person or a vehicle operated by another person, without that person's consent, in the course of soliciting or begging;

    (3)

    Intentionally blocking or interfering with the safe or free passage of a pedestrian or vehicle by any means, including unreasonably causing a pedestrian or vehicle operator to take evasive action to avoid physical contact; or

    (4)

    Using violent or threatening gestures toward a person being solicited or begged.

    Charitable organization means:

    (1)

    A group, society, association or corporation which is or holds itself out to be a benevolent, civic, educational, fraternal, voluntary health, philanthropic, humane, patriotic religious, reformatory or eleemosynary organization.

    (2)

    Any person who (1) solicits or obtains contributions solicited from the public for charitable purposes or (2) offers for sale any merchandise, goods or services whatsoever upon the representation or implication that the proceeds or profits of the sale or will be used for charitable purposes.

    (3)

    A chapter, branch, area, office or similar affiliate or any person soliciting contributions within the city for a charitable organization which has its principal place of business outside the city.

    Hawker means any person who sells or offers to sell at wholesale or retail any commodity, product, goods, wares or merchandise of any kind or nature whatsoever from a stand, wagon, vehicle, motor vehicle, container or push cart.

    Peddler means any person who travels from door to door or from house to house or from place to place selling or offering to sell or advertising for sale any commodity, product, goods, wares or merchandise of any kind or nature whatsoever.

    Solicit or beg shall mean using the spoken or written word, or bodily gestures, signs or other means with the purpose of obtaining an immediate donation of money or other thing of value.

    Solicitor means any person who travels from door to door or from house to house or from place to place or upon the public streets or upon any public or vacant private ground soliciting any kind of business, work, trade or orders for any commodity, product, goods, wares or merchandise without prior invitation of the owner or owners or bona fide regular occupant of the premises.
